A man was placed in a residential care facility by his niece after she was no longer able to care for him at her home. During a period of personal trouble, the niece was unable to visit her uncle at which time he was transferred to a Skilled Nursing Facility without the niece’s knowledge.
The man eventually ended up in a hospital due to very serious bedsores. His injuries became so severe that he had to be debrided and received a colostomy. Within 60 days of returning to the care facility he died of his injuries. The uncle suffered from both negligence and elder neglect.
This case settled in favor of the family.
